It's "Lien", not "Lein"...

Just a quick note about the spelling of the word "lien"...
The "i" actually comes before the "e" but it's spelled "lein" so often that I've gone ahead and used both on this page. :)

There are a couple different types of lien release forms in construction

These are the conditional and unconditional lien release forms that you use when you're invoicing on a project or collecting a progress or final payment on a project.

#1 Conditional Lien Waiver and Release Upon Progress Payment form

The #1 Conditional Lien Waiver and Release Upon Progress Payment form is used when you are invoicing for a partial payment on a job.

A partial payment can consist of the entire dollar amount less retention or it can consist of any partial amount of the contract.

#2 Unconditional Lien Waiver and Release Upon Progress Payment form

The #2 Unconditional Lien Waiver and Release Upon Progress Payment form is used when you have received a progress payment on a project and it has cleared both your and your customer's accounts.

#3 Conditional Lien Waiver and Release Upon Final Payment form

The #3 Conditional Lien Waiver and Release Upon Final Payment form is used when you are invoicing for a final payment on a project, whether it's retention or just simply a final payment.

#4 Unconditional Lien Waiver and Release Upon Final Payment form

The #4 Unconditional Lien Waiver and Release Upon Final Payment form is used ONLY AFTER you have been paid full on a project and that payment has CLEARED both your and your customer's accounts, NEVER before.

Once you issue the #4 Unconditional Release you have given up ALL of your lien rights so NEVER issue the #4 release form until that final payment has cleared and the customer can't take it back.
