#2 Unconditional Lien Waiver and Release Upon Progress Payment form

Use this unconditional waiver release form to PARTIALLY release your lien rights AFTER you've received a partial payment on a construction project and AFTER that partial payment has cleared your and your customer's bank accounts, and can NOT be recalled (or "payment stopped") by your customer.

When you submit an invoice for a partial payment on a construction job you'll typically include a #1 conditional release form on progress payment.

It isn't until AFTER you've received that partial payment and AFTER that payment has cleared both your and your customer's bank accounts and can no longer be stopped by your customer that you'll use this #2 Unconditional waiver and release upon progress payment.

Once you give the #2 unconditional upon progress to your customer you have unconditionally released your rights to any liens on that portion of the project. "Unconditional" means you have released those rights UNCONDITIONALLY, there are NO conditions that will give you those rights back.

That's why you don't give this form until AFTER your customer can no longer stop that payment. :)
